Terms & Conditions

These terms govern your membership of and access to The Collectors Club (“the Platform”, “the Club”, “we”, “us”, “our”), a private members’ community. They apply whether you use the Club through our website or through our iOS or Android applications. By applying for membership, or by signing in and using the Platform, you agree to these terms. If you do not agree with them, please do not use the Platform.

Eligibility

You must be at least eighteen years old and able to enter into a legally binding agreement to use the Platform. Membership is intended for serious private collectors, and is not open to the general public. We may ask you to verify your identity as part of your application.

Membership

Membership is granted at our sole discretion following a successful application and identity verification. We reserve the right to decline any application without giving a reason. Membership is personal, non-transferable, and may not be shared. You are responsible for keeping your sign-in credentials confidential and for all activity that takes place under your account. Please tell us at once if you believe your account has been accessed without your permission.

Your collection and wishlist

You may record the pieces you own and the pieces you are seeking, and you decide what is visible to other members, what remains private, and what is made available to our matching process. You are responsible for the accuracy of what you enter, and for ensuring you have the right to offer any piece you make available. Please do not record an item you do not own, cannot lawfully sell, or have already agreed to sell elsewhere.

Introductions and matching

The Club may quietly introduce two members whose collection and wishlist appear to align. An introduction is only ever made where both members have chosen to accept it. An introduction is exactly that — an introduction. It is not a recommendation, a valuation, an endorsement of either member, or any assurance as to a piece or a person. What follows an introduction is a private matter between the two members concerned.

Transactions and commission

The Collectors Club facilitates introductions between members. We are not a party to any transaction between members and accept no liability for the condition, authenticity, title, description, or value of any item exchanged. We do not authenticate watches, and members deal with one another entirely at their own risk. We strongly recommend that both parties satisfy themselves as to the identity and standing of the other, and as to any piece, before completing any deal.

Where a deal is completed following an introduction or through the Platform, a commission of ten per cent (10%) of the agreed price is payable by the seller on completion. Commission is settled by bank transfer against an invoice we issue. Commission is non-refundable once paid, save where a dispute is upheld in the seller’s favour under the process below.

The Knightsbridge handover

For certain deals, members may choose to complete an in-person handover at our London office, arranged through the Platform. The handover is a facility we provide for the members’ convenience and confidence. It does not make us a party to the transaction, nor does our presence constitute any warranty as to a piece or its authenticity.

Messaging

Messages between members are end-to-end encrypted. We hold only encrypted content and cannot read your conversations. Where we are given proper grounds to do so, we may disable a member’s ability to send new messages, but we cannot and do not read existing message content.

Editorial content

Members may submit articles and comments, which we review before they appear. You retain ownership of what you write, and you grant us a non-exclusive, royalty-free licence to publish it on the Platform and, where you have chosen to make it shareable, beyond it. You are responsible for ensuring your contributions are your own work, are accurate, and do not infringe anyone else’s rights. We may decline, edit, or remove any contribution at our discretion.

Conduct

Members must not use the Platform to engage in fraud, misrepresentation, harassment, money laundering, or any other unlawful activity, and must not attempt to interfere with the security or proper working of the Platform. We reserve the right to suspend or terminate any membership immediately and without notice where we believe these terms have been breached, or where we consider it necessary to protect other members or the Club.

Disputes between members

If a dispute arises from a deal, either member may raise it with us. We will review the matter in good faith and may act as an informal mediator, but we are not obliged to resolve disputes, we are not a party to the underlying transaction, and any decision we reach affects only the commission we hold. Members remain responsible for pursuing their own remedies against one another.

Limitation of liability

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be excluded. Subject to that, the Platform is provided on an “as available” basis, and to the maximum extent permitted by law we shall not be liable for any indirect, incidental, or consequential loss, nor for any loss arising from a transaction between members, the acts or omissions of any member, or the authenticity, condition, or title of any piece.

Ending your membership

You may leave the Club at any time and delete your account and data. Details of how to do so, and of what happens to your information, are set out on our account deletion page.

Changes and governing law

We may update these terms from time to time. Where a change is material we will let members know. Your continued use of the Platform after a change takes effect means you accept the revised terms. These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising from them.
